The report drafted by Freedom House Romania on the recovery of losses and confiscation of the proceeds of crime to give an overview of the recovery of damages sustained by the Romanian state and of the confiscation of assets acquired illegally. The report follows three aspects which define key moments in fraud investigation, recovery of damages and dispossession of the proceeds of crime: (1) analysis of the capacity of the criminal prosecution bodies to impose efficient precautionary measures; (2) analysis of practice of the courts of law, including their use of new legal institutions such as extended confiscation, and (3) assessment of the enforcement of confiscation orders and of the interest shown by institutions to initiate civil trials.
